My question involves a traffic ticket from the state of: Minnesota
Hello all,
I was stopped last night by a Minnesota State Trooper on the basis that I was signaling my turns using hand signals at night on my motorcycle. I was issued citations for numerous reasons- improper percentage of reflective surface on my brake light, address not changed on my license within 30 days, not using turn signals, no proof of insurance (insured, didn't have my card). As I was waiting for him to write the tickets in the car I had looked up the statute regarding hand signals in Minnesota because I was pretty sure there was nothing that said it was illegal. By the time he got back to me with the ticket I had the statute pulled on my phone and had read it, specifically 169.19 subd. 7 & 8-
Subd. 7.Signaling methods.
The signals herein required shall be given either by means of the hand and arm or by a signal lamp or signal device of a type approved by the commissioner of public safety, but when a vehicle is so constructed or loaded that a hand and arm signal would not be visible in normal sunlight, and at night both to the front and rear of such vehicle, then the signals must be given by such a lamp or device.
Subd. 8.Hand signals.
When the signal is given by means of the hand and arm the driver shall indicate intention to start, stop, or turn by extending the hand and arm from and beyond the left side of the vehicle in the following manner and these signals shall indicate as follows:
(1) left turn: hand and arm extended horizontally;
(2) right turn: hand and arm extended upward, except that a bicyclist or motorcyclist may extend the right hand and arm horizontally to the right side of the bicycle or motorcycle;
(3) stop or decrease speed: hand and arm extended downward.

The officer had cited me under subdivision 7 of the statute. I asked him if he could clarify to me specifically how I was in violation of the statute. He simply stated that it was because I was '.using hand signals at night, that I should read the rest of the statute. it says it in there somewhere.' I have read the statute in it's entirety as well as any other state statute pertaining to signaling or lighting on a vehicle in Minnesota and can find nowhere that directly or indirectly states that you cannot use hand signals at night. The only other statute I can find that could be argued is 169.57 subd. 2-
Subd. 2.Turn signal.
(a) Any vehicle may be equipped, and when required under this chapter shall be equipped, with a lamp or lamps or mechanical signal device of such color as may be approved by the commissioner of public safety and capable of clearly indicating any intention to turn either to the right or to the left and shall be visible and understandable during both daytime and nighttime from a distance of 100 feet both to the front and rear.
(b) On or after July 1, 1949, it shall be unlawful for any person to sell or offer for sale any new motor vehicle, excepting motorcycles, motor scooters, and bicycles with motor attached, unless it is equipped with turn signals meeting the requirements of this chapter.

However, it is my assumption that if violation of this statute were to be argued the officer would have to make mention of an inability to see my hand signals beyond 100ft. to which there was no mention. I try very hard to ride in accordance to the law and stay informed of our states statutes and this is extremely aggravating for me, can someone please help me understand what is going on here? Thank you.
